EB5 investment requirements

The investor must demonstrate the legal origin of the funds to be used for the investment.

The required investment amount is

- US$ 800,000 for projects located in targeted employment areas (TEA), or areas of high interest to the U.S. government.

- US$ 1,050,000 for projects outside these areas.

This classification or designation is determined by the U.S. Government based on the location of the project.

Projects must be approved by USCIS through Form I-956F.

An additional US$80,000 in administrative expenses is required.

The capital must be fully invested for the time stipulated in the contract of the project chosen by the investor.

The investor must present documentation proving the legal origin of the capital to be invested.
Filing of the application:
With the accompaniment of an immigration attorney, the EB-5 Visa petition is filed on Form I-526E with the U.S. Citizenship and Immigration Services (USCIS).

Be a citizen of a country that maintains a treaty of commerce and navigation with the United States. Eligible countries include: Argentina, Chile, Colombia, Costa Rica, Mexico, Panama, Honduras, Paraguay, Spain, Germany, Portugal and Italy.
Have invested or be in the active process of investing a substantial amount of capital in a company with operations in the United States.
Have the intention to actively develop and direct the business. This is demonstrated by at least 50% shareholding or by operational control through a management position or equivalent structure.
Investments of a passive or speculative nature, such as the purchase and sale of real estate without active participation in the management of the business, do not qualify as substantial investments.
The investor's children are covered by the E-2 Visa up to 21 years of age, provided they are unmarried and dependent.

To apply for the E-2 Visa, the investor must have a valid B1/B2 Tourist and Business Visa or enter the country through the Visa Waiver Program (ESTA).

No. The fund to be invested can be in an account in your country of residence, in the United States or in a third country.

No. The purchase of properties in the U.S. does not give you an immigration benefit.
